Tax enquiries have become part of the life of a taxpayer and tax reporter alike. It encompasses what HM Revenue &
Customs term Interventions in the enquiry process. As part of our function in assisting individuals, sole traders, partnerships,
trusts and companies, The City Directorate recommends Tax Resolve as an expert in handling and seeking to
settle tax cases.
It has become increasingly important, because of the firmer line taken by Revenue officials and inspectors, that taxpayers
challenge HM Revenue & Customs and seek a resolution of their situation.
Settling Cases
The policy of Tax Resolve is to settle tax cases wherever possible, using our internal strategist to
this end; it provides the services of professionals from our experienced panel of qualified lawyers and tax practitioners,
but the main part of its work is dealt with "in-house" by its own personnel.
In addition to Tax Resolve's own initiatives in seeking to settle tax disputes with HM Revenue &
Customs, there is now, under their new appeals procedure with effect from 1st April 2009, a statutory entitlement to
a Revenue review of appealable decisions.
Appeal Procedure
It is often necessary in order to reach a settlement of a case that an appeals procedure is followed so that HM Revenue
& Customs know the strength of the taxpayer's case. This procedure involves statements of facts (for agreement with the
Revenue), issues for determination, witness statements, documents appraisal, etc. These can be time-consuming, and specialist
tasks. Tax Resolve seeks to deal with these tasks efficiently and resourcefully from its own experience and
expertise.
It has become the practivce of HM Customs & Excise to rely on its own manuals. These are not necessarily definitive
of tax statutes or practice on which appeals are determined. Tax Resolve will rely on the law and established
tax pactice to seek to ensure the taxpayer's position is advanced legally.
In its work, Tax Resolve predominantly works with other professional firms. It also provides a service
of researching precedent tax cases and points of legal principle to assist in tax matters.
